Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Blossom mobile application and related services (collectively, the "Service") operated by Blossom ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. Users between 13 and 17 must have the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
3. The Service
Blossom is a marketplace that connects clients with independent beauty professionals ("Technicians") and businesses. Blossom is not the provider of the beauty services listed on the platform and is not a party to any agreement between a client and a Technician. Bookings, services, and outcomes are the responsibility of the client and Technician.
4. Bookings and Payments
- All bookings are made between the client and the Technician. Blossom facilitates the transaction and holds funds via Stripe until the service is completed.
- Platform fees apply to each booking as disclosed in-app. Current rates: Discovery 7% (capped) plus Checkout 2.5%, subject to change with notice.
- Shop product purchases incur a 15% platform fee to the vendor, deducted from the gross sale.
- Refund and cancellation policies are set per-Technician and shown before a booking is confirmed.
- Payment processing is provided by Stripe and is subject to Stripe's terms.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Post content that is defamatory, obscene, harassing, threatening, or otherwise objectionable.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the Service or servers connected to the Service.
- Use the Service to send unsolicited communications, advertising, or spam.
- Circumvent the platform to take transactions off-platform after a connection was made via Blossom.
6. Technician Obligations
If you register as a Technician or business, you additionally agree to:
- Hold all licenses, permits, and insurance required to provide the services you list.
- Provide accurate pricing, availability, service descriptions, and portfolio content.
- Honor confirmed bookings or provide timely notice of cancellation per your stated policy.
- Complete Stripe Connect onboarding and provide accurate tax information.
- Comply with all applicable health, safety, and consumer-protection laws.
7. User Content
You retain ownership of content you upload to the Service (photos, reviews, messages). By uploading content, you grant Blossom a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as necessary to operate the Service. You represent that you have all rights necessary to grant this license.
We reserve the right to remove content that violates these Terms or that we determine is harmful to the platform or its users.
8. Intellectual Property
The Service, including its design, code, branding, and content (excluding user-generated content), is owned by Blossom and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.
9. Disputes Between Users
Disputes between clients and Technicians (e.g., service quality, no-shows, refunds) should first be resolved between the parties through in-app messaging. If unresolved, you may escalate via support@blossom.app. Blossom may, at its discretion, mediate disputes and issue refunds or platform-level adjustments. Our decisions are final.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BLOSSOM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY TECHNICIANS, NOR THE TRUTH OR ACCURACY OF USER CONTENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOSSOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless Blossom and its affiliates, officers, employees, and agents from any claim, liability, damage, or expense arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by following the deletion process described in our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles. You agree that any dispute arising under these Terms shall be resolved in the state or federal courts located in Harris County, Texas.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, providing additional notice through the app or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
